Terms of Use

Escape is a web and a smartphone/device application for which lets you escape from a meeting or any other situation. It just displays a call screen along with a sound which is similar to a phone call on the device, you just need to open the app set the interval (default 5 secs) for the fake call screen to appear then shake the device and wait for the call screen to appear. Escape is developed and run by The Service Provider Systems Pvt. Ltd. (hereafter referred to as "Service Provider"), having its registered office at 34/1 Crescent Road, Bangalore 560 001, India.

Escape application is available via a web browser or it is installable on a smartphone ( iOS and Android platforms at the present). An iOS application ('app') is a small computer program that runs on the iPhone/iPad. An Android app is the similar but designed to be downloaded onto Android phones. The User ("You", "you") by using Escape ("Service"), are agreeing to be bound by the following terms and conditions ("Terms of Service"). The service, provided herein comprises of: (a) Escape app By using the services offered by the Service Provider, you agree to be bound by Terms of Use herein, by simply using the LinkPin web application or the LinkPin app. You are authorised to use the Services only upon your acceptance of the terms hereunder.

The User ("You", "you") by using Escape ("Service"), are agreeing to be bound by the following terms and conditions ("Terms of Service"). A limited, non-transferable, non-exclusive license is granted to use the Escape app and Escape web application. All right, title and interest, including all intellectual property rights, in and to the Software and Service remains with The Service Provider Systems Private Limited. You may not, nor may you allow any third party to, (a) modify, adapt, translate or create derivative works of the Software; (b) decompile, disassemble, reverse engineer, or otherwise attempt to discern the source code of the Software (c) sublicense, copy, transmit or distribute the Software; or (d) use the Software on a time-sharing or service bureau basis, or otherwise provide services to third parties using the Software.

Acceptance of Terms

By agreeing to use the Services, you are agreeing to be bound by the Terms hereunder.

Nature of Use

The services of Escape are intended for personal use only. No User shall use Escape for resale purposes or commercial purposes without express written permission from the Service Provider.

Intellectual Property & Proprietary Rights and Licenses

All intellectual property rights, proprietary rights, title, interest in the application/tools/services provided hereunder, of whatsoever nature belongs to the Service Provider and/or authorised by a third party for use by the Service Provider and any use of the same in any manner either directly or indirectly, either in whole or in part is strictly forbidden.

Prohibited Uses

You agree that you shall not violate any applicable laws through the use of the Services or collect or store data about other people using the Services; use any devise, software to interfere or attempt to interfere with the proper working of the Services or access to the Services; reproduce, duplicate, copy, sell, resell or exploit for any commercial purpose any portion of the Service or use the Services in any manner other than as expressly authorised in these Terms.

User Contents

For the sake of clarity, it is agreed and understood that the Service Provider does not own, control, or otherwise be responsible for the content that may be stored by the Users in their online accounts or on their browsers and the respective Users shall alone be responsible for any consequences resulting from storage or usage of any such contents. However, the Service Provider reserves its right to remove or delete any material found unsuitable for any reason whatsoever, at its discretion, apart from the right to forthwith terminate the Service provided by it to such User whose content has been found to be objectionable.

Limitation of Liability and Disclaimer of Warranties

You fully understand and agree that the use of the Services hereunder is at your own discretion and risk and that you will be solely responsible for any damage that may arise from such use. Under no circumstances shall the Service Provider be liable for any direct, indirect, special, incidental, consequential or punitive damages of any kind, or any other damages whatsoever, including without limitation, damages related to use, misuse, reliance on, inability to use and interruption, suspension or termination of the website or services, damages incurred through any links provided on this website or the non-performance thereof and any other damage whether or not the Service Provider has been advised of such possibility. The Service Provider expressly excludes all warranties relating to the uninterrupted, timely, secure, error-free use of the Services.

Service Compatibility

The Service provided herein may be compatible with most popular web browsers (Firefox, Chrome, Internet Explorer and Safari), iOS and Android platforms. However, this is not to suggest that the Service Provider has any tie-up with any of these service providers. From time to time, the Service Provider may issue an update to the application that may add, modify, and/or remove features from the application or Service. These updates may be pushed out automatically with little or no notice, although The Service Provider will do everything in its power to notify you in advance of an upcoming update, including details on what the update includes. Additionally, The Service Provider (and hence you) has to abide by the Terms and Conditions set by Apple (for iPhone and iPad applications) and Android Marketplace (for Android applications). You understand that the Service Provider uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run the Service. Hence, the Service Provider does not warrant that (i) the Service will meet your specific requirements, (ii) the Service will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the Service will be accurate or reliable, (iv) the quality of any products, services, information, or other material purchased or obtained by you through the Service will meet your expectations, and (v) any errors in the Service will be corrected.

Indemnity

You agree to defend, indemnify and hold the Service Provider, its directors, officers, agents and affiliates harmless from any and all claims, liabilities, damages, costs and expenses, including reasonable attorney's fees, in any way arising from or related to your violation of these Terms, or your use of the Services provided herein, including without limitation any third party claim that any User content (or any part thereof) that you upload, post or distribute infringes any intellectual property right of any third party or defames, invades any right of privacy or otherwise infringes any other right of a third party

The Services provided herein may be supported by advertising revenue and may display advertisements and promotions related or otherwise to Services provided herein. Any decision to utilize advertising and the manner, mode, extent and terms of such advertising is subject to change. The Service Provider is not responsible or liable for any loss or damage of any sort incurred by the Users as a result of such advertising. Further, the User's interaction with the advertisers and any reliance on such advertisements and any commercial transaction or obligation resulting therefrom is solely between the User and such advertisers.

Governing Law, Dispute Resolution and Jurisdiction

General

The Terms constitute the entire agreement between the User and the Service Provider and governs the use of the Services provided herein. The User may not assign the Terms or any of the rights or obligations hereunder without the Service Provider's prior written consent.

Changes and Updates

The Service Provider reserves the right to change or alter these Terms at any time, without any prior notice to its Users.

Privacy Policy

By agreeing to the Terms, you are deemed to have agreed to the Privacy Policy hereof. You have read this agreement and Agree to all of the Provisions contained here in above.
